Wisconsin Overtime Law

Wisconsin overtime law applies to most of the state's employers, including factories, mechanical establishments, restaurants, retail stores and others. Covered workers, regardless of age, must be paid 1 1/2 times their regular rate of pay for all hours worked in excess of 40 hours a week.

Generally, employers:

  • Must calculate overtime pay based on hours worked in a single week
  • May not enter into agreements with employees to waive overtime pay
  • Must pay overtime even if they did not request or authorize the overtime hours
  • Must provide at least a 30-minute duty-free meal period per six-hour shift to employees under 18 years of age (and are encouraged to provide similar breaks for adults)
  • Must pay for rest periods or breaks of 30 minutes or less
