What To Do After A Car Accident

After an accident, you will likely have to deal with law enforcement, insurance adjusters, opposing attorneys and medical care providers.

To best protect your safety and preserve any claims for damages you may have after a car accident, consult an experienced personal injury attorney as soon as possible. Also remember these important details regarding what to do if you are involved in an accident:

  1. Do not leave the scene. Wisconsin law requires that the driver of an automobile involved in a collision to stop at the scene of any collision that has resulted in personal injury, death, or property damage.
  2. Seek medical treatment as soon as you can. If you are at the scene, request an ambulance. If it is too late, go to the nearest emergency room. If you are in pain the next day, go to your primary care physician.
  3. Call 911. As soon as possible, call 911 if anyone has complaints of pain or seems to be dazed or disoriented.
  4. Move your vehicle to a safe place. Move your vehicle out of the road to prevent further damage and keep the road safe for other motorists.
  5. Provide information to the authorities. Unless your injury requires immediate care, remain at the scene of the collision until the police have arrived and authorized you to leave.
  6. Do not admit fault. Do not volunteer any information about who may have been at fault in causing the collision.
  7. Do not offer to pay for anyone else's damages at the scene. Your offer to pay someone for their damages is an implied admission of fault.
  8. Document the collision and take photos, if possible. Even if the police complete a report, you should create your own documentation of the collision. Identify everyone at the scene, including the people involved and any witnesses.
  9. Report the accident to your insurer. Call your automobile insurance company and provide them with the details of the accident. Any delay in reporting the accident could result in a denial of your insurance coverage. Note: DO NOT PROVIDE THEM WITH A RECORDED STATEMENT PRIOR TO SPEAKING WITH A LAWYER.
